Public-Private Partnerships: "The PPP is one way to start the Grenelle"

Wednesday and Thursday meetings are held the international public-private partnerships (PPP) at convention center Paris. The appointment of all public and private actors involved in designing, financing, implementation, management and maintenance of public facilities and services under the PPP contract is the second edition of the genre.

On this occasion, "The Monitor" Martinand met Claude, Vice-President of the General Council on Environment and Development sustainable, president of the Institute for Responsible Management (IGD). In the aftermath of the reform of PPP July 28, 2008, in a difficult financial environment, Claude Martinand an update on the future of these contracts. It is realistic but optimistic.


reform on July 28 it seems you able to revive the public-private partnership (PPP), especially in this time of crisis?

In 2002, RMI had taken an initiative for a new contract to complete the toolkit of PPP. This first initiative has resulted in the order of June 17, 2004. Our second initiative led to the adoption of the Law of 28 July 2008 which expands the use of partnership contract.
Concerning the crisis, it should be noted that these contracts are long term and are paid by the public and / or users. Does the attractiveness of these contracts has been degraded by the crisis? It is likely, but keep in mind that the solvency of communities is good, and that these contracts provide for claims and where necessary secure assets for lenders. And it is not clear that communities can benefit for themselves from borrowing conditions attractive in the current context. If you want to revive the economy, and to realize the Grenelle, the PPP is one of the best ways to mobilize.


Do you think that negotiated the new procedure will be used?

It is restricted to contracts where the total amount, the total duration is limited. This will restrict the use of the procedure, but will however SMEs to access them more easily. The difficulty for them is to manage such contracts over time. The acceptance of assignments of receivables to the banks is limited to 80% investment on the part of the rent, except in the case of a long lease (BEA) of less than 10 million euros, to which it can go up to 100%. If such a BEA has been also a screening, the contract is eligible for the compensation fund for VAT (FCTVA).


Improvements in the financial system and tax you seem sufficient?

The possibility for the partner to enhance the field of public person is useful, as for the stadium project in Lille. The law reaffirms the principle of fiscal neutrality between contracts, but this is toujours pas admis par un certain nombre d'administrations, ce qui est regrettable. Sur le plan fiscal, si je n’ai pas le sentiment que les choses aillent très loin concrètement; cela va néanmoins dans le bon sens. Les subventions peuvent désormais être affectées au projet, même s’il est porté par un partenaire privé. Quoi qu’il en soit, on a plus que jamais besoin d’infrastructures nouvelles: dans les transports, dans l’énergie et les réseaux, les équipements et les bâtiments.


Savez-vous si des personnes publiques envisagent d’ores et déjà d’utiliser le nouveau critère "bilan coût/avantages" ?

Where are you in launching the School of PPPs where the IGD taken the initiative?

In its letter of 1 October 2007 * President of the Republic had supported the development of PPPs, but said officials hoped the training of these new contracts. We have created a "School of PPP, which is a multifaceted device training. Pantheon-Assas, Paris-X, ENPC and MAPPP kindly lend their support to this project. We must thank them. Ten ways to preserve the investment capacity of communities

How can local communities continue to meet the demands of society, while the state of their finances does little more leeway? They are at the foot of the wall.
